ARRL audio recordings are in no way comparable to Richard Bebout speaking on amateur radio frequencies with his FCC issued license KA6JMM. Basically, Richard Bebout should stick to eating his numerous Wienerschnitzel hot dogs and avoid performances as a sidewalk lawyer. The ARRL is a noncommercial organization of radio amateurs that produces publications in print and via electronic media for radio amateurs. The ARRL retains copyright of their material but expressly allows Amateur radio operators to rebroadcast audio recordings created for the amateur radio community. Those recordings are distinctly different from the simple act of Richard Bebout communicating as an FCC licensed amateur radio operator KA6JMM with other amateur radio operators such as N6FTW, KM6ACH and so on. Richard Bebout broadcasts his voice using amateur radio equipment from 21795 Walnut Street, Wildomar California or while driving his blue 1994 Jeep Cherokee. He broadcasts his voice to the public over many amateur radio frequencies including the W6CDW repeater operating on FCC allocated frequencies of 144.895 MHz, 145,495 MHz, 445.620 MHz and 440.620 MHz that are specifically for Amateur Radio service. FCC regulations expressly _allow_ the recording of such conversations which are non-commercial and are unprotected from recording or claims of copyright. In addition, the FCC expressly forbids amateur radio operators from engaging in any sort of broadcasting over amateur radio frequencies. If Richard Bebout's voice broadcast was based on prerecorded, commercial copyrighted material Richard Bebout would be in violation of FCC rules: Prohibited transmissions. (a) No amateur station shall transmit: (1) Communications specifically prohibited elsewhere in this part; (2) Communications for hire or for material compensation, direct or indirect, paid or promised, except as otherwise provided in these rules; (3) Communications in which the station licensee or control operator has a pecuniary interest, including communications on behalf of an employer [with certain exceptions]. (4) Music using a phone emission except as specifically provided elsewhere in this section; communications intended to facilitate a criminal act; messages encoded for the purpose of obscuring their meaning, except as otherwise provided herein; obscene or indecent words or language; or false or deceptive messages, signals or identification. (5) Communications, on a regular basis, which could reasonably be furnished alternatively through other radio services. (b) An amateur station shall not engage in any form of broadcasting, nor may an amateur station transmit one-way communications except as specifically provided in these rules; nor shall an amateur station engage in any activity related to program production or news gathering for broadcasting purposes, except that communications directly related to the immediate safety of human life or the protection of property may be provided by amateur stations to broadcasters for dissemination to the public where no other means of communication is reasonably available before or at the time of the event. (e) No station shall retransmit programs or signals emanating from any type of radio station other than an amateur station, except propagation and weather forecast information intended for use by the general public and originated from United States Government stations.
